A company which wants to request a Poland Work Permit from Poland’s immigration authorities for a non-EU person needs to undergo a mandatory labor market check. The check will indicate whether there is a Polish or EU citizen who can do the job as they have the hiring preference over non EU citizens. If there is no suitable candidate among the applicants for the jobs posted, an employer may apply for a work permit for a suitable foreign worker. Upon furnishing the job offer, the employer is supposed to apply for the work permit which will contain details on the job title, company name and job description. The application must witness that the conditions of employment are conforming to the employment act and labor code of the Polish authorities. Also, salary offered must align with the wage rates decided by the Voivodeship office, according to which wages should not be 30% below the average monthly wage.
