Requirements for Obtaining a Work Permit in Poland

If you are the citizen of a country that lies outside of the EU Zone and planning to reside and work in Poland you require a work permit to enter and work in Poland. In case you decide to change your employer, you have to obtain a new work permit. Usually, each particular permit is usually valid for up to three years.

The Polish Authorities Provide 5 Categories of Work Permits/Visas.

Category A:

If you apply for the work visa required for Poland and find work based upon an authentic employment agreement or civil law agreement with an authorized company based in Poland. This is one of the most sought after and preferred job licenses.

Category b:

This specific job license stands valid if you are a company board member. Also required under this category is the condition that you are living in Poland for an overall duration of the license that goes beyond 6 consecutive months within the duration of 12 subsequent months.

Category C:

You can apply for obtaining this job license if you are flown out to Poland as an international company representative for greater than 30 days in a fiscal year for the purpose of managing the international company’s subsidiary or branch in Poland.

Category D:

You are duly qualified for this job license/visa if it is required by an international company for you to explore export oriented solutions on a short-term basis. It is to be noted that the international company is not required to have a branch or subsidiary in Poland. 

Category E:

You can apply for this visa if you intend to work in occupational jobs that do not fall under any one of the above 4 categories. 

Necessary Documentation to be submitted to Polish Authorities by the Company

  1. A thoroughly completed job application submitted by the candidate
  2. Due proof of settlement of all application related costs
  3. Verification of lawful standing of the company with the National Court Register in Poland
  4. Present up-to-date documents of the employing company’s financial statements
  5. Verifiable duplicate copies of the candidate’s key traveling details corresponding with respective employment dates
  6. Proof of candidate’s medical and dental insurance with valid coverage for Poland
  7. A valid and legal job contract between the company and the candidate 
  8. A copy of a declaration pertaining to revenues or losses financial statement of the company
  9. A copy of an agreement pertaining to the required solution being given by employee’s expertise in Poland

  1. A company which wants to request a Poland Work Permit from Poland’s immigration authorities for a non-EU person needs to undergo a mandatory labor market check. The check will indicate whether there is a Polish or EU citizen who can do the job as they have the hiring preference over non EU citizens. If there is no suitable candidate among the applicants for the jobs posted, an employer may apply for a work permit for a suitable foreign worker. Upon furnishing the job offer, the employer is supposed to apply for the work permit which will contain details on the job title, company name and job description. The application must witness that the conditions of employment are conforming to the employment act and labor code of the Polish authorities. Also, salary offered must align with the wage rates decided by the Voivodeship office, according to which wages should not be 30% below the average monthly wage.
